1. Acceptance of Terms
By accessing or using the SAFacts website (“the Platform”), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Platform.
2. Description of Service
SAFacts is a data platform that aggregates and presents source-attributed statistics from official South African government sources. The Platform is currently in beta and is provided on an “as is” and “as available” basis. Features, data, and availability may change without prior notice.
3. Permitted Use
You may use the Platform for:
- Personal, educational, and non-commercial research purposes
- Citing SAFacts data in publications, provided you attribute both SAFacts and the original government source
- Sharing links to SAFacts pages on social media and other platforms
4. Prohibited Use
You may not:
- Scrape, harvest, or systematically download data from the Platform without prior written permission
- Misrepresent, alter, or present SAFacts data in a misleading manner
- Commercially redistribute SAFacts' compiled datasets or visualisations without a licence agreement
- Attempt to disrupt, damage, or gain unauthorised access to the Platform or its infrastructure
- Use the Platform to distribute malware, spam, or unlawful content
5. Intellectual Property
The underlying data presented on SAFacts is sourced from publicly available South African government records. SAFacts' presentation, design, compiled datasets, visualisations, risk index methodology, and original written content are the intellectual property of SAFacts and are protected by South African copyright law.
6. Disclaimer of Warranties
The Platform is provided “as is” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. SAFacts does not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.
7. Limitation of Liability
To the maximum extent permitted by South African law, SAFacts and its contributors shall not be held liable for any damages arising from your use of or reliance on the Platform, including direct, indirect, incidental, consequential, or punitive damages.
8. User Accounts
Certain features may require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. SAFacts reserves the right to suspend or terminate accounts that violate these Terms.
9. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the South African courts.
